  •  Correction re: 5 gallons of gasoline (7+ / 0-)

$2 worth of unleaded was purchased prior to the Happy Land Social Club Fire.  Gas was just under a buck a gallon.
Arsonists often like plastic pails, or to repurpose windshield washer fluid containers.

If they're that dangerous, what could they do with a Monster Truck or a dump truck during recess in a schoolyard? Or a farmers market, or five gallons of gasoline in a social club?
I've gone on-record in favor of ending blanket "Felon" prohibition, while encouraging incorporation of "crime of violence" as the new State and Federal standard.
We saw this was needed in domestic violence situations, and it resulted in some improvement.  If we expanded this to all "crimes of violence" - regardless of misdemeanor status, we'd catch far more sociopathic people with poorly defined border skills.
    Border: My body, no touching.

I agree, the "assault on a police officer" can be the same as "resisting arrest".
Your non-violent, non-cooperation, requiring officers to lift and carry you to the transportation vehicle, qualifies.

In NYS there's a statute: Obstruction of Governmental Administration.  It's the catch-all reason for you to be arrested.  The constitutionally valid vagrant/loitering law.
Standing on a streetcorner wearing a Cuomo Sucks t-shirt?
Move-along... you're obstructing civilian pedestrians, and obstructing the view of motorist to see clearly down the block.  First Amendment?  No.  Now you're taking-up my time, and causing me to not respond to potential emergencies.  You.  Are under arrest.

Let me give you the revised Miranda warning, adopted after 9/11 just for people like you:
You have the right to have that smirk smacked off your face.  The right to smash your nose on the partition, when I have to brake from 60mph to 0, due to the squirrel running out in front of the cruiser.
The right to trip repeatedly while handcuffed.
The right to be put into a cell without a phone call for 72 hours, without heat, without air conditioning, without a blanket, shoes, belt, or that fucking shirt.
Do you understand these rights as I've explained them to you?
    Welcome to the real world.
    •  I wouldn't necessarily go as far as all (5+ / 0-)

misdemeanor crimes of violence. One barfight should not be sufficient.

Repeated misdemeanor battery offenses, especially the higher degrees thereof, should put someone in that status.
