  •  I think what reich is saying is that repeal is by (6+ / 0-)

    voting on new bill to repeal the old law and then measure signed by President into law, not by defunding law with threat to shut down the government if Senate and President don't cave.

    The Constitution sanctions voting, not holding the government hostage as a means to defund existing law, which is now more complicated because i don't think you can defund those who sign up for entitlements now under ACA.

    I'm also not focused on filing a legal action, just on changing how we discuss what is happening, because this is not politics as usual.

      government hostage, since it gives each house plenary power to pass bills out of the house.  the house of reps is under no legal obligation whatsoever to pass a CR, nor are they prohibited from using it as a bargaining chip.

      this is a political issue, not a legal one, and the remedy lies at the ballot box.
