    -- judging gradations of originality -- has anything to do with 2A infringement is, well, pretty weak.  We can, perhaps, argue what it means to "keep" or "bear" whatever should be considered "arms," but that's about it.  Is that your analogy?

    And as for this:

    The words that grant that right in the constitution are right there in the Constitution that was ratified on first pass. They weren't added later by Amendment.
    That's pretty desperate.  Amendments are just as much a part of the Constitution as the "first pass" stuff.

      that the word infringement does not have a simple meaning that is fixed and invariant in time, or that it's presence in the 2A makes the meaning of the 2A so clear.
