    In other words, no one can ask the US Supreme Court to rule on the constitutionality of a hypothetical scenario, only live 'cases and controversies'.

    For the Supreme Court to actually rule on this issue, either President Obama would abrogate the debt ceiling law, and someone would have to file suit, or President Obama would have to sue the House to force it to lift the debt ceiling.
