  •  The minority party in the Senate (6+ / 0-)

can defeat any bill the President wants. Obviously the House reactionaries have to be defeated but that won't fix the imbalance of power that filibuster abuse has created.

    •  But in the Senate (3+ / 0-)

there's a remedy.  Nobody is really anxious to use it, because it cuts both ways, but the routine abuse of the filibuster has been exposed as vulnerable already.  Would Reid actually pull the nuclear trigger?  Perhaps.  That's not what's important. What's important is that the Senate GOP caucus believes he would, given the right circumstances. And honestly, given the way the prevailing wind is blowing, if he was ever gonna do it, this would be the time.

Yes, the nuclear option does cut both ways. If possible it should remain a threat -- to be used only as a last resort to avoid a debt default with catastrophic consequences.

But Harry Reid should extract concession for not using it, including:

-- No more blockade of Obama appointments that have clear majority support
-- Henceforth all filibusters must be talking filibusters
-- Raising the debt limit through 2014
-- Elimination of Senate rules that require unanimous consent
        -- Elimination on anonymous holds

        •  I'd agree with most of that (0+ / 0-)

all except tying the debt ceiling to it.  The rest are germane -- and clear abuses of the filibuster that could trigger a "nuclear" response.  But the debt ceiling is really more of a House issue and unless it comes to the Senate for a vote, the filibuster isn't connected to it.  Now if a bill on the debt ceiling came to the Senate and they tried to filibuster THAT, then you have a straight line form A-to-B.  But I can't see that happening.  McConnell wouldn't have the balls to do it, but McCain or Corker or one of the other grumpy old men would slap Cruz sideways if he pulled a stunt like that.
