    It means evil mind or evil intent. The crime is intent, not whether the "victim" is actually a victim. Same principle as when a sting operation is set up.  Stings are designed so that law enforcement officers, investigators or volunteers are not at personal risk. The crime is the intent of the perp to commit the crime, and then engage in criminal activity.

    It matters not one whit if the victim of the crime is a computer or a human. Change this over to the stings where there may not be an image, but perhaps fake bank transfers. It is all photons on a screen. If the perp intends to commit a crime, and believes he or she is committing a crime, then it is prosecutable as a crime.
