    they are not "ex" until the new people are sworn in, probably in January.

    Secondly, Cuccinelli is Attorney General, not Lt. Governor.  So he wouldn't become acting governor in this scenario, current Lt. Governor Bolling (not former) would take the position.  I can't imagine Cuccinelli doing that because it would have seriously improved Bollings chances in the primary.

      The Star Scientific stuff, and the potential Coochie Coup, happened in August and September of this year.

      By that point, Cuccinelli was already the GOP nominee, having been nominated at the GOP convention three months prior, back in May. (The VA GOP nominated from a convention this year rather than a primary, thanks to Cooch's people being concerned about Bolling in a primary.)

      But you're right to write that this would have given Bolling a lot more prominence, and that alone was reason enough for Cooch to pull back—given that Bolling had already all but endorsed McAuliffe.
