    In this case, what has happened is that by allowing this to stand untl there is an appeal, the question becomes whether or not the facilities will be standing.

    The 5th Circuit will hear the argument in January.  It doesn't mean they will rule on this argument in January.   So, at a minimum we are looking at a few months, and in the meantime, facilities may find themselves on the wrong side of the law; fines and the inability to stay open are legitimate concerns.

    This of course was the argument used by PP, but it is not really that big of a leap

      opinion and the basis for refusing to issue the stay was essentially that the State was going to prevail on the merits.  

      I agree with your irreparable harm argument—I don't think there's much room for debate there.  I just don't think that's ever going to matter one lick…the 5th Cir. all but said that it would uphold the restrictions once it ruled on the merits.

        Hitch means verdict, then appeal, and let's say it goes Rocket Docket and comes up USSC, depending on when the decide it would be on the fall docket.. Ie, potential for a year lag. Minimum of a sixth month lag
