DC Circuit Rejects Challenge to DC Gun Laws

By Kevin Fayle on October 5, 2011 10:23 AM

The DC Circuit has upheld the gun laws passed by the District of Columbia after the Supreme Court struck down prior DC firearm regulations. The laws at issue in the suit imposed registration requirements and prohibited assault weapons and high-capacity magazines. The court found that the laws did not violate the Second Amendment.

Readers of Firearms Law and Policy can look for a diary on this case in the next week or two. The Plaintiff is the same Mr. Heller who brought the Heller v DC suit decided by the Supreme Court in 2008. For those who like to read ahead, the link above takes you to the DC Circuit Court of Appeals, which is arguably the second most important court in the nation.

There are currently 3 judicial vacancies in the DC Circuit and the GOP has refused to allow any of the nominations to proceed to a vote...

    ... until today.
