    In his testimony before the Judiciary Committee, he specifically stated that states had the right to prohibit birth control, simply for the reason of population expansion.  I ain't making this up, I watched it.  Bork was an a**hole.  THAT is why he was not confirmed, and a majority of the population at the time agreed.  What in the hell does this have to do with anything?

      way he fired achibald cox.

      DoJ rules specified that cox had tenure,
      bork fired him, then retroactively removed the rules

      I watched those hearings,  too. There is zero question that Ted Kennedy was right to sound the alarm about Bork and stop him. Unfortunately, one thing both sides "learned" from this was to nominate candidates without paper trails so that it would be hard to find objective reasons to block them.  Scalia and Alito are just as rightwing as Bork--Scalia maybe more so. But, at the time of confirmation, they had few written records to derail them.

      And candidates facing confirmation (including Elena Kagan who protested this practice) learned to say nothing before the Senate Judiciary Committee "because that issue may come before the Court." No shit. That's PRECISELY why we want to hear your views on it!
