    There's only one way to solve this problem permanently, and that's for Right Wing Watch to take YouTube out of the equation by hosting their own videos, the way, e.g., Media Matters for America does.

    YouTube is in the business of showing videos. Arguably they're really in the business of selling advertising space, and the videos are just a hook. They're definitely not in the business of showing any particular videos. YouTube is a for-profit business: what potentially loses them profit (in the form of lawsuits) will lose out to what potentially gains them profit (in the form of ad views) every time. The profit motive inevitably leads to safe, non-controversial, non-lawsuit-prone, utterly boring kitty videos dominating the YouTube landscape.

    Basically, don't expect anything remotely interesting to stay up on YouTube for long, don't rely on YouTube's video hosting if you want anything to stay up, and if you do see anything interesting on YouTube, download that shiznit ASAP.

    Of course this isn't unique to YouTube, plenty of video hosts have the same problem caused by the same profit motive, the only way to ensure something is done to your satisfaction is to do it yourself.

      Flingenshit is running for Colorado State House of Representatives in Colorado Springs, and didn't want his homophobic crazy broadcast on Youtube, hence the DMCA abuse against RWW.

      Right Wing Watch has chosen YouTube as their conduit. I do know that nothing they have uploaded violates fair use. They should be able to load their legal videos to any operation they so choose.

      If a single Orly Taitz level intellect floods the legal department with complaints, then there is no recourse for the person uploading. I.e. there is no counter-suit for nuisance complaints and no classification of a professional plaintiff.

      I won't get into the "they did it first" arguments, because it's enough for the right wing to believe that there were professional left wing plaintiffs to begin actually paying "Housewife and Mother" plaintiffs to bring suits from town to town in the 1980's and to read the moderation rules to make a first posting a complaint about rules abuse on the BBS systems of the 1990's. (The belief that Robert Bork was "Borked" was enough for the right wing to arbitrarily block judicial appointments as "payback." In the same way, the belief that there were liberals who lived on Welfare and did nothing but sued was sufficient for various evangelical movements to pay members to be "concerned citizens.")

      Until there is a legitimate demerit for frivolous complaint, there is nothing but advantage about claiming copyright infringement on everything from whomever one does not like.

      Everyone's innocent of some crime.
