clothes that were for sale on Ebay? Ebay pulled that. Why shouldn't Amazon or Wal-Mart pull something from their site when they learn of the possibly illegal or at least unethical use of art?

I think they still have an ethical responsibility here, since they are getting their cut.

    •  Didn't I say stop making me defend Walmart? (0+ / 0-)

When somebody builds a shop on Wayfair, they accept all responsibility for owning the copyrights or trademarks to the products they sell. Same goes for selling on any online marketplace, like Walmart's marketplace. The seller is liable and responsible, not Walmart. (sadly...)

The holocaust items for sale on Ebay were taken down because they violated Ebay's policies on stolen goods directly, not because of a copyright dispute. If original paintings could only be sold by the original artist/copyright holder, they'd never be sold. The Banksy items on Walmart are copies, not originals, therefore violate copyright law.

Walmart should take it down, I agree -- but not unless/until copyright theft is proven. I'm a graphic designer, my work gets stolen all the time, so these laws are something I wholeheartedly respect and deal with frequently.

Prove the infringement, then remove them immediately.
