    ...which was the premise for striking down US laws of that sort, doesn't exist in Indian constitutionalism. So to that extent it's not a surprising decision.  Recall that there was some debate about whether the US actually had such an enshrined right.

    The other element is that the Supreme Court presides over a three-ring circus of High Courts whose first instinct is take over the legislative function--typically in the interests of what we'd recognize as good causes, but it's not really a good way to run a country.  If the SC wants to send a message that legislatures (national and state) should be the locus of policymaking, this is a good case to pick because like it or not, it's a more contentious issue than dowry deaths or acid attacks.

      soon follow.  Nothing like having tens of thousands of people rounded up and locked away for who knows how long.  Not that most of them will survive their mandatory 10 year sentence.

          the court's decision and the only way they can actually do that is by enforcing the law whenever possible.  That means mass arrests of people who came out and "confessed" after the lower court ruled it invalid.
