        appearances are all entertainment workproduct, performance art and drama having little or nothing to do with any physical reality about what goes on in the oil and gas industry.   The erroneous statements claiming that hydraulic fracturing and the oil and gas industry are exempt from the Clean Water Act and the Clean Air Act at the very beginning of Gasland is the tip-off that Josh Fox's act is conflation and fabrication posing as a documentary.

          act that Cheney got for his oil and gas buddies? That is what they are talking about.  So maybe all along your misunderstaning of what was being said has fueled your perceptions? But I doubt it.

          •  There is absolutely no exception contained in the (0+ / 0-)

            Federal Clean Water Act (33 U.S.C. Sec 1251, et seq.) addressing process wastewater from hydraulic fracturing and the oil and gas industry.   Any oil and gas industry operator that discharges to  navigable waters of the United States or their tributaries is subject to a requirement for a Clean Water Act NPDES permit and any such discharges to surface waters are regulated by the CWA..

            Josh Fox saying that the oil and gas industry is exempt from the Clean Water Act is deliberate lie done for dramatic and manipulative effect at the beginning of the original Gasland movie.

            Democrats and advocates of environmental protection and conservation who rely on public respect for the scientific concensus on global warming and greenhouse gas emission control requirements jeopardize that public support by relying on Josh Fox/Gasland anti-science performance art and drama to make decisions about proper environmental enforcement and regulation of the oil and gas industry.

              and gas operator made to surface waters without a discharge permit is a serious violation of the Clean Water Act, punishable by up to $25,000 per day in civil and criminal penalties.

                the current regulatory authority under the Clean Water Act concerning hydraulic fracturing operations and process wastewater discharges to Waters of the United States from oil and gas operations.

                As a preliminary, please understand that the Federal Clean Water Act and the Federal Safe Drinking Water Act are two different statutes that regulate two different things.

                Next, please confront the fact that this EPA Clean Water Act enforcement action against an oil and gas industry operator could never have taken place if the oil and gas industry and hydraulic fracturing fluids/process wastewater were exempt from the Clean Water Act:

                First, there are no amendments to the Clean Water Act contained in the 2005 Energy Policy Act that had any effect at all on requirements that an oil and gas industry source discharging process wastewater and/or hydraulic fracturing fluids to Waters of the United States (meaning surface water, navigable waterways and their tributaries) have a permit for any such discharge.

                Second, nothing contained in the 2005 Energy Policy Act affected at all any current or previous authority making a discharge to Waters of the United States a serious Clean Water Act violation.

                Finally, nothing in the 2005 Energy Policy Act amended
                the Federal Clean Air Act in any manner at all.

                So, as a result, when Josh Fox said this in the first Gasland movie.....

                “What I didn’t know was that the 2005 energy bill pushed through Congress by Dick Cheney exempts the oil and natural gas industries from the Safe Drinking Water Act.  They were also exempt from the Clean Air Act, the  Clean Water Act, the Superfund law, and about a dozen other environmental and Democratic regulations.”
                ....everything he said here is lie.   Even the statement about the Safe Drinking Water Act is wrong because the exemption for the oil and gas industry in that Act is only for the underground injection permit requirement.   All other requirements and authorities of that Act still apply to the oil and gas industry.   This statement was made by Josh Fox in the movie for dramatic effect and has nothing at all to do with reality.

          •  There is an entire section of the Federal (0+ / 0-)

            Clean Water Act, Section 311 (33 U.S.C. Sec 1321) dedicated to oil and hazardous substance liability from discharges of hydrocarbon wastes or fuels to surface waters.

            These are the kind of things that Josh Fox was lying about at the very start of the first Gasland movie.   If the artist and drama director Fox has to tell you about Section 311, it takes away from the drama and emotional manipulation achieved by telling millions of people that hydraulic fracturing and the oil and gas industry are exempt from the Clean Water Act when they are not.

            Gasland is not a documentary.

            Gasland is not legitimate science or engineering.

            Gasland is not legitimate environmental/conservation advocacy or environmental enforcement activity.
