    It wouldn't surprise me in the least if TransCanada were to sue the feds, challenging rejection of KXL, on the basis that ERM shouldn't have had the contract because it lied on the conflict of interest filing.

    The only prudent course of action, it seems to me, is for the conflict of interest investigation to be concluded first, because if it isn't resolved, the disappointed will use that to question the outcome.

    If there was a conflict of interest with ERM, the State Department should recruit a new contractor and direct them to start from scratch.
