    The judge in my NH probate court was a conservative French Catholic, not the brightest legal mind but a good dose of common sense. Even if the girl was pregnant (as was usually the case), and had parental consent, he would not necessarily sign the waiver. He figured it was likely not to last, so he was just creating work for the "upstairs" judges in divorce court.

    And yes, if you have a pregnant 14-year-old, even if the parents and the judge consent to the marriage, the man is guilty of statutory rape. I believe the statutory rape law has an exception for people under 16 who are legally married. If it doesn't, as a practical matter once the probate judge has signed off on it, the DA isn't going to press charges.
