    From the article:

After a 16-hour standoff with the Grand Forks, North Dakota SWAT team, police called in a predator drone on loan from the Department of Homeland Security's Customs and Border Patrol. The drone located Brossart and his three armed sons, then notified police of the opportune time to step in and make an arrest.
He was in a standoff with the police. There was no shortage of probable cause for aerial surveillance. If it hadn't been a drone, it would've been a helicopter instead, and there would have been absolutely no question about the legality of aerial surveillance from a helicopter in this situation.

So exactly what makes a drone such a "fail" here?

I'll answer your question: nothing.  Arresting men in a armed standoff with nobody hurt is a positive story, a long way from fucked up fail.
