  •  The issues of prosecuting rape cases (11+ / 0-)

    Are many fold.   They include problems that often are:

    * One person's word against another
    * Reluctant victims
    * Delays in reporting
    * Societal prosecution and response.

    There are some solutions to this that do not undermine the justice system (ie, changing the 'innocent until proven' which still remains critical).   The changes that should be made are:

    * Faster and better use of immediate evidence, Rape Kit processing.   Right now, the US lags BADLY in rape kit processing.  Many cities are behind months and more in how long it takes them to process a rape kit.   This falls into the camp of: justice delayed is justice denied.   The longer it takes for this evidence to be processed, the more likely the victim is to want to move away from prosecution to get past the issue.   Faster rape kit turnarounds are critical.   Problem with this: it requires money.  And yes, tax payers right now seemingly don't want to pay for anything.   But this is the kind of thing tax dollars SHOULD cover.

    * Victims are largely reluctant because we are drastically cutting their resources available to them, and because there aren't more people advocating on their behalf.   That takes more shelters, taking them more seriously from the beginning, and better infrastructure for the mental health care many need afterwards.  It also applies to reproductive rights, removing anxieties of reporting rape at any hospital and being able to get immediate MAP response.

    * See the above for improving reporting.  Make people know that all hospitals will take them and judgement on their choices will not be forced on them.

    Finally, society has to be open in demanding more resources go to toward the and they have to be open in letting women and men who are victims know that they will support them through recovery.
