    #31 - Accident?  No.  Foreseeable consequence of puling the trigger of a loaded gun….twice….apparently after taking it off safe. In fact if it DIDNT fire that would be remarkable.

    Ill go back to NASCAR.  In almost every race at some point you can go "oh here comes a wreck."  If you know what to look for you can tell that the way people are driving is going to lead to a wreck.  Too many cars trying to occupy the same space.  Now that is not an accident, it is a wreck and it is the foreseeable consequence of the way people were driving and the choices they were making.  

    If I go out and drink 10 beers in 2 hours and then get in a car and wreck it that is not an accident, it is a forceable consequence.  If I get in my car stone sober and hit pothole while coming around a corner causing my front tire to blow and then lose steering and hit a pole, that is an accident.

    If you take weapon that is designed for killing and handle it carelessly while ignoring simple safety rules and that results in death or injury, that is not an accident.  It is just as much a foreseeable consequence as wrecking a car while blasted drunk.
