    but in New York, you don't have to prove premeditation. "Depraved indifference" to human life is enough. And they should have been able to find that here.

      My father-in-law is a retired attorney, now living in FL.  According to him, the way the law is written down there, lesser charges are ALWAYS on the table unless the Judge specifically instructs the jury that they are not.  So, unless the jury was told not to consider a 2nd degree conviction, they could have done so. Why they didn't is beyond me - but then again, so is most southern stupidity.

      OF COURSE the New Right is wrong - but that doesn't make WRONG the new RIGHT!
