    I used to think as you do -- that every justice should come to the oral argument as a blank slate.  I don't anymore.  It is the purpose of the briefs and the record on appeal to make the case.  If any attorney comes the Supreme Court thinking he or she has 9 open minds, then I'll show you someone who needs to update a professional liability policy.  Oral argument isn't for convincing a panel of undecided justices.  It is for filling in the holes.  If it were the primary activity of the case, then it would last a whole heck of a lot longer than the 60 minutes or whatever the Justices allot.  The justices should have a pretty strong idea about how they will vote before oral argument.  If they were all undecided, then there must have been some pretty crappy briefs.
