Which I originally posted as a Facebook Status:

The State of Michigan is putting on an extremely strange case in the current federal "Michigan Gay Marriage Ban" trial. All the witnesses that the state is bringing forward have a similar message: "It's better for children to be raised by their biological parents or--if that's not possible--a married couple consisting of a man and a woman.

And yet--none of that is relevant to the actual case brought by the plaintiffs. Their children are being raised by a monogamous lesbian couple--and there is NO POSSIBLE RULING that will change that. Additionally, LGBT parents are adopting kids in Michigan all the time, and NO POSSIBLE RULING will change that. What this is actually about is whether both of the individuals who are raising these children (and will continue to regardless of the outcome of this trial) should both be recognized as LEGAL parents... and it doesn't appear that the state is even asking questions to their own witnesses about that topic.

Again: These children DO have lesbian parents. They WILL have lesbian parents for the rest of their lives. Full stop. The best outcome the state can possibly hope for in this case is that the status quo continues--in which the actual legal system CONTRIBUTES to any real or perceived negative outcomes of that relationship by making it harder for them to act as parents. In other words - the IDEAL outcome for the state is an outcome that makes the lives of the children MORE difficult.

I would argue that the fact that it is ALSO now part of the state's case that all gay people are hellbound does little to respond to the actual case brought by the plaintiffs.

This was their failure in CA's Prop H8 case  The supporters of the proposition offered no substantive testimony and revealed the paucity of their own arguments.

In other words: There's no "there" there.
