    The Republicans have succeeded in robbing a two-term President of what is every President's most important legacy: the mark he leaves on the judiciary.

    It does not have to be this way. After years of shilly-shallying Reid finally implemented weak filibuster reform. But the obstruction of even totally uncontroversial judicial appointments continues. Republicans know that with the population trending Democratic, their best hope lies in right wing judicial activism. Their hope is that judgeships will remain unfilled, and that the next Republican president will get to have double the impact on the judiciary --- filling not only the new vacancies that arise during his term, but also the ones left over from Obama.

    And Reid has so far rolled over and let them do it.

      There's also Pat Leahy, Judiciary Committee Chair and gentleman, who continues to honor blue slips from Republican senators - even on candidates nominated by that same senator.

    •  Reid should schedule a vote-a-thon (8+ / 0-)

      to clear the decks of the 27 nominees that are pending on the Senate floor - most of them since 2013.

      The 5 Circuit court nominees could take up to 30 hours each, meaning the GOP could kill a week of Senate time stalling them. However, the 22 District court nominees can only be delayed 2 hours each, so they could all be cleared in 2 days even if Republicans delay them to the max.

      That would clear 27 of the 85 current vacancies - about a third - and knock the vacancies down to 58. This would also fill 12 Judicial Emergencies - also about a 1/3 of the total emergencies.

      These nominees have all cleared the Judiciary Committee - Reid needs to get their floor votes scheduled.
