    Much litigation ends up in mediation or arbitration anyhow. And that's cases that don't settle before a complaint is filed or in the early stages of litigation

    But limiting consumers to binding arbitration isn't in the best interests of consumers nor, for that matter, justice.

    Some cases really should be tried in front of a judge or jury. The trial system isn't perfect, but it's a very good system.
