  •  The Founders were certainly proponents (7+ / 0-)

    of civil disobedience.

Well, sorta.  Didn't cotton to Shays's or Whiskey.

What I mean is that due process is an established process, and the dissent is to be within the law -- if it violates the law, then one accepts the penalties.

What I also mean, more fundamentally, is that the right-wing/"conservative" view which asserts that "freedom" and "rule of law" are antagonists is false.  It is law which secures freedom; and law which provides remedies for violations of those freedoms.

Thus "ordered liberty": everyone has the same rights -- and therefore the responsibility not to infringe others' exercise of those rights.  (Every right is inextricably entwined with responsibility, responsibility being a limitation.)

In essence, quoting Thoreau out of context tends to risk misrepresenting those basics.

This is the country of those three great rights: freedom of conscience, freedom of speech, and the wisdom never to exercise either of them. -- Mark Twain.
