  •  The flaw is not in the first amendment (10+ / 0-)

    it's in the idea that money = speech.  It does not.  The constitution gives the ability to fix thing like this through the process described here.

      Money is the way to exercise rights effectively.

       I hope you would see that while a ban on spending money in connection with an abortion technically would not limit the right to an abortion, but would practically gut it -and therefore would be unconstitutional and opposed by all of those of us who favor abortion.   Similarly, a ban on spending money to speak would effectively gut the right to do so.

        Giving one group access to abortion facilities over another does not affect the ability of either party to participate in politics.  On the other hand, it has been shown that one group of people with money has way more access to politician than people without money.

        I almost admire your attempt to bring abortion into this.  Are you Mark Rubio?
