    were just waiting for some backup to make favorable rulings.  They knew inequality when they saw it, but feared to be on the bleeding edge.

      How do you ask the last service member to die in a hopeless war?

      Well, how do you ask the last judge to rule against love?

      It's possible that this never makes it to SCOTUS because the circuit courts all decide in one direction...  

      Circuit court judges have got to be above average in education and intelligence, even if they are conservatives. It's hard to imagine anyone functioning in the upper levels of the legal profession not knowing some gay or lesbian couples, and not realizing how ridiculous it is to oppose this any longer.

      Remember that aside from the SCOTUS, judges have no choice in which cases they hear. A judge hears a particular case because a) someone brought it and b) his court system randomly assigned the case to him. There's no initiative on any judge's part.

      As for how they rule, every single judge to rule on an ME case since Windsor has ruled in favor. That makes it hard to argue that they've been waiting for "permission" (other than the precedent they see in Windsor) to rule a particular way.

      The reason we're seeing the pace of favorable rulings speed up is simply that a lot of cases were filed in rapid succession and they've now reached the final-decision stage.
