    Could an executive order provide for private funding of enforcement?  Say, the Sierra Club brings a lawsuit to enforce, and wins.  Loser pays its fees?

      No one can spend money without Congressional Approval.  

      Specifically, the House.

      public can act as an enforcer, but they can only recover legal fees. I don't think private parties can directly fund government employees who are in an enforcement role. Government can outsource enforcement activities, but that takes funding just like having government employees. Private parties could help fund cleanup or pollution control technology for coal activities, but that doesn't seem feasible.
