    1) is like saying "it's not the fall, but the sudden stop at the bottom."

    2) not "as long as." Unless.  Are you suggesting this is a case of "child abandonment?"

    3)  "Police were called?"  What is that a test of?

    4)  The question is not whether she could have done better. The test is not whether the parenting is ideal.  In this case, neither you nor I have any idea what law she actually violated. I'll bet there is no law against allowing a child of 9 to play unsupervised in a park.  I'll bet that she is being hassled on some general law that forbids "endangering" a child.  That may not be unconstitutionally vague as applied to driving recklessly while intoxicated with a child unrestrained in the front seat, but it is unconstitutionally vague as applied to this situation.

    A right answer to the wrong question is a wrong answer.
