    I'd say there might be some element of political brinksmanship here.  The President is warning the GOP off of impeaching him, with the threat of pursuing torture charges against the Bush Administration.

    An official, high-profile investigation into Bush Admin torture would outstrip the House suing the President over the employer mandate in the ACA.  One is simple and easy to understand for everyone, while also being highly volatile.  One is basically a boring, wonkish policy argument.

    So I'm being extremely cynical but...

    The President promises mutually assured destruction.  He reminds the GOP of the Sword of Damocles hanging over all their heads from Bush-era torture activities.  And if the Republicans back down, it gives Obama apologists a talking point for his legacy.  Now they can claim he made it an issue (even though he only did so years late and with an eye to beating back an impeachment threat).

    What was wrong under Republicans is still wrong under Democrats.
