    A felony??? It's shoplifting. A misdemeanor. And there have been SCOTUS rulings regarding when it is appropriate to shoot a fleeing suspect. Generally, you don't shoot just because he's going to get away and you're too slow to catch him.

    If he's a danger to the community, then it's justified. And in some cases, if he's charged with a felony. But the SCOTUS ruling I'm thinking of would not agree that shooting someone dead with his hands up for stealing cigars is constitutional.

    I think it was on Rachel Maddow last night that she talked about this, and that Missouri law might not be constitutional under this ruling.
