  •  Perhaps you hadn't noticed, but the Ferguson (14+ / 0-)

PD and other local forces who have sent officers to assist in the town don't seem to be following generally standard practices - of any kind.

Aiming high powered military surplus weapons at unarmed citizens who are practicing their 1st Amendment Right to peaceably assemble? (which you likely know is a violation of the UCMJ for US Military members [absent the Civil Rights of US citizens], as has been noted by a voluminous number of Veterans and is thus even more heinous when practiced by LEOs against their own civilian population here at home)

Being recorded: aiming their weapons at Press who bear visible credentials (or at least a shirt with glow in the dark PRESS on it), declaring they will shoot those Press for offenses unknown, acting as though the Press' 1st Amendment Right to observe and report on the actions of Gov't (or it's agents) does not exist by excluding them from areas of Ferguson under the notion that "we can't ensure your safety" - when these same Press don't hear that while observing and reporting on Foreign Wars from in Theatre.

The list of shit these supposed Law Enforcement officers have been NOT doing according to generally accepted standard practices is unconscionably long.

What I don't understand is why an Officer of the Court, as a practicing attorney, you would ignore these blatant violations of Civil Rights and the Constitution in favor of continuing to repeat how things are supposed to go?

Your post discusses what is happening in the police dealings with the demonstrators and the press covering the demonstrators.  That's simply a different issue from what I was discussing, which is the investigation into the events that occurred between Brown and Wilson.
      •  Why hasnt Officer GFY been charged with assault? (0+ / 0-)
      •  You aren't ignoring it, but you also haven't been (3+ / 0-)

addressing this aspect of the situation. You cannot extricate one issue from the other; the two are completely interrelated and speak to the basic credibility of the PD, which is very much something that any attorney would attempt to verify first about his or her witnesses.

You seem to have determined, and I say this from your posts, that the Ferguson PD and other involved agencies ARE credible despite extensive proof that they are not credible. Based on this, you then discuss the matter as if it can be reasoned through, but if we cannot first establish that the PD has a pattern of not behaving in a credible fashion, we cannot establish that the facts that they present are credible either. This is so basic that it hurts. And you surely know this. So I'm unclear how you can actually make the argument that the two are not related and are "different topics."
