    They would have to amend the constitution itself, from my non-lawyer understanding of the law.

    First off, has anyone such as the ACLU challenged the Patriot Act? I would think a group or individual would have to challenge the Patriot Act as a violation of the 4th Amendment, and then it would have to make its way up the courts, possibly to SCOTUS.

    And with a soon-to-be solid right-wing majority on SCOTUS, I'll bet we can say good-bye to the Fourth Amendment, and part of the First.
