    The 9th and 10th amendments say and mean nothing, they were added to pacify the Constitution opponents.

    The constitution also doesn't say you have a right to pick your wife.  It doesn't say a LOT of things but we all know, being intelligent human beings, that there is a lot more to the rights enumerated and not than the exact words themselves.  As for the 9th, it is NOT nonsense.  Madison was dead serious in his offering it up. He was NOT playing a game.  I suggest you read his own words on the matter.  The Founders themselves mention penumbras as well.  Madison was very much behind the 9th.  In any case, there are no nonsense/inapplicable amendents.  By definition they are ALL applicable 100% of the time.  Period.  No ifs, ands, or buts.  No wishy-washy nonsense here, the 9th states flat-out that there are any number of unenumerated rights and that not a single one of them is any less a right that is fully protected than any that were enumerated.  The words (and Madison's own) speak clearly for themselves.  You don't get to pick and choose what amendments are OK and which aren't.


    Navy vet my ass.  I have no idea what oath YOU took but mine didn't say anything about protecting and defending parts of the Constitution.

      Look into how the "conservative" justices justify the Constitutional right to Expressive Association (the right that justified the boy scouts from excluded gay leaders).  I can't remember the exact phrase - but they either invoke the word or the standard of the "PENUMBRA".  This doesn't speak to either of your point exactly - but if we're going to debate what the constitution does and doesn't say - let's at least admit, neither side of this debate on the court has a corner on consistancy.
