    Not to prohibitions on activity by individual.  Otherwise selling your body organs would also be constitutionally protected.  Saying that there is a right to privacy does not make it so.

      You and Whelan reject the 100 year tradition of Constitutional interpretation, as I detail above.

      The enumerated rights theory is simply not mainstream. It is extreme.

      Fine. You can argue it respectably. But you can't sit on the SCOTUS, not by my lights.

      The SCOTUS is Extraordinary.
