    And that is?

    The SCOTUS is Extraordinary.

    •  That the nominee (none)
matches the Justice. Roberts for WHR is, at worst, an even exchange. I still say his nomination will come back to bite Bush in the butt.

Now that expectation has to be met with regards to O'Connor. Who will it be? Good question. But since everyone around here seems to be focusing on Roe v. Wade, I'll toss a name sure to fry everyone's eyeballs.

Alberto Gonzales. He voted in the majority with regards to In re Jane Doe cases in Texas and granted a bypass himself. He also weakened the Admin. brief for the UMich AA case. Social conservatives hate the guy. And Bush is so freaking loyal to the guy I wouldn't be surprised one bit to see his name come up.

Personally, I'd like Easterbrook. He's another brilliant legal mind.

      •  So there will never be change? (none)
If each justice is supposed to mirror the positions and attitudes of the justice he/she is replacing, that means the ideological composition of the court will never change. (Unless, of course, a stealth candidate gets in.)

And if we are further and further constrained in our choices because of the attitudes or positions of some dead and gone justices, what's the point?

As if those constraints aren't enough, we're presented with candidates who are so reprehensible (and/or whacko - or dare I say -stealth?), that they refuse to share their previous writings or explain their thinking or position on ANYTHING. And Congree obliges by not requiring full (hell - even partial) disclosure. I couldn't get a job as a crash dummy if I interviewed like that!

        What is the point?

Just what the fuck is the point?

Some days I just run put of hope and belief in the future of this country.

        And Congress doesn't help.

We must have stem-cell research. How else will Congress and the media grow spines?
