    Both Iraq and the Supreme Court are critical. Here's why.

    Bush, the self-styled "war president," has claimed the broad wartime powers of FDR. He's gotten most of what he wanted from the federal courts, but not everything (e.g., the Hamdi decision). Judges like Roberts--who ruled that military commission trials for accused terrorists were constitutional--will give him the rest of the power he wants.

    The Commander-in-Chief power is, in my opinion, the number-one threat to our civil liberties. This president believes that he has unfettered discretion to declare anyone an "enemy combatant" and that his decision to do so is beyond the purview of the courts. Pretty scary, if you ask me.
