    ... I don't think that is what is going on here and consequently not what we will see.

    I don't know a lot about Miers yet but my gut level reaction is that this is already a victory for those left of Ashcroft and that she has been nominated because she will be confirmed without a big fight.

    I read this nomination (and Roberts) as a signal that the Democrats and moderates won the Supreme Court battle with the right wing with the nuclear option compromise. Bush gets to nominate a couple cronies and claim victory but the fanatics on the right do not get what they want. The left never had a chance of getting someone they wanted so it really has always been a matter of stopping the Luttig's and Pryor's and Roy Moore's of the world.

    It really points out the truth of the couple West Wing shows done on Supreme Court nominations. The mediocre wins out, the nation and the court as a whole loses, and neither the right nor the left gets what they want.

    I will be very surprised if this confirmation turns into a battleground. Bush capitulated and the Senate Democrats will quietly accept that capitulation.

    I could be wrong, something may come out that changes this, but that is what my gut tells me is going on here.
