    I didn't take Kos's argument to be that we ought to like Miers, not at all.  Rather the argument is that we are not going to like any Bush nominee, but we face the problem that he won the election.  And that by long tradition, Presidents get to nominate justices who broadly agree with the President.   This is one of the reasons that losing that last election was so horrible, but lose it we did.  

    Further, Kos's point is that alternative Bush nominees would probably be much worse, and indeed would have been worse had he not been politically weakened.
