    On December 30, 2004 attorneys for David Cobb and Michael Badnarik went to federal court and demanded that the recount be done again, this time in conformance with state and federal law.    

    In October 2005, they modified the lawsuit so that they are no longer asking that the recount be done again.  They are, as they have been since the beginning of the process, focusing on the long range goals of the litigation and are now only asking for what is known as a "declaratory judgment;" a judicial ruling that the recount was conducted in violation of the law.

     If issued by the judge, this will be a monumental decision in American history because it will provide us with something we've never had before:  parameters for the conduct of presidential recounts.

    The case is set for trial for August 22, 2006, which will follow months of discovery and contested pre-trial motions.

      To the thoughtful posters who responded to me, especially you two with the info on the court actions. Sounds like there would actually be three lawsuits, the two mentioned above and possibly a third cause of action independently based on the constitutionality of the pending "reform." We will see--the courts have not yet been so corrupted that they can ignore the plain, written law and clear precedents. At least, this suspicious law could be tied up for years, maybe even until 2008. Texas has been working for years to find a (state) constitutional way to fund education. Keep the faith!
