    The court might not accept the fact that the info used to seek wiretap was secured by torturing someone in a secret prison.

      in the oral argument in the Hamdi case before the Supreme Court, then Deputy Solicitor General (now Solicitor General) Paul Clement assure the justices that they could rely on the executive branch not to torture.  Later that same day of the oral argument, CBS broadcast the photos from Abu Ghraib.

      Ever since, I've wondered whether Clement knowingly lied to the court, or the administration had been feeding him false information.
