    Um, if you don't want to risk "making history," you don't take your dispute to court, and you try like hell to get it settled if you're a defendant.  Every published legal opinion is "making history" and establishing precedent for future cases, that's how the whole system works.  It's why my clients worry about "making bad law" for future cases and for the rest of the industry, and why they often settle before trial to avoid just that possibility.  What a stupid argument.
