    The first challenge is likely to come in Florida, where lawyers for two men charged with Jose Padilla, who is jailed as an enemy combatant, plan to file a motion as early as next week to determine if the NSA program was used to gain incriminating information on their clients and their suspected ties to al-Qaida.

    If the Supreme Court takes up Judge Luttig's invitation and accepts the Padilla case now, that may involve an examination of the warrantless surveillance program.

      It's Bush's Supreme Court now.

        The uncomfortable thing to me in this somewhat curious 'Luttig denies Bush wishes on Padilla case' meme being spread widely through the US  media, is that none of the journalists is asking Padilla's attorneys (Padilla does have attorneys, doesn't he, or is that just another quaint, outdated concept that Bush has found necessary to discard to keep Americans "safe" from the WOT?) or getting any statement from them  what Padilla wants to happen here.
