    Considering the goal of permitting recess appointments i would say this sort of behavior twists the process to different ends.

    But considering the recess appointment has been abused by everyone--and is pretty much accepted to allow this, although out of (i suppose) courtesy nobody i know of has been this blatant about it--and given Bush's millions of other problems this is not what i would focus on.

    In articles of impeachment i would throw it in under "abusing the public trust" or some such.

      Did some more reading and it does seem to be regularly (ab)used.  Doesn't make it right, but as you said, bigger fish to fry.  It does make you wonder what problems are buried in that list of names though.  I'm sure they'll be scrutinized by various watchdogs and we'll find out.
