    ... if scAlito fails to convince the committee he's worthy to sit on the SCOTUS. They keep crying there should be no "litmus test".

    FRIST: No. And, you know, you're trying -- and I -- not -- not you, but I think many people -- and you will see it among some of the Democrats questioning -- is trying to capture a single issue and -- and use that as a litmus test, in terms of determining whether or not an individual who is highly qualified, demonstrated the utmost integrity -- his mastery of -- of legal opinion and legal judgment have been demonstrated -- that all of that should be negated or supported because of a single issue. It created a constitutional right. And these decisions removed a fully appropriate political judgment from the people of the several states and has led to many adverse consequences.       All three of the above are REPUBLICANS -- and it's the Repugs who are insisting there be no Roe litmus test.

        We all know Chimp's litmus test.  His nominees are going to vote to overturn RvW (unless he makes a serious miscalculation).

        It is important to consider the other reasons why he nominates his candidates.  If voting for Alito = increased power given to the Executive branch, you will be darn sure that the 'limited power' Republicans are going to have a hard time voting for him.

        •  Roe wil be eroded, not overturned (none)
          Alito's strategy recommendations during the Reagan Admin were incremental - allow states to erode Roe to the point where it is almost meaningless. He took a simialr tactical approach on other issues as well.

          This will continue, not a complete reversal.

          Radical results through ostensibly moderate means.

          This is the their covert stealth strategy, and it stokes the wingnut base while avoiding real media and political accountability.
