      for now.  If Scalito gets in, they're just 1 vote away.

    •  In Hamdi, only Thomas bought the unitary (none)
      executive theory.  All other eight justices, including Scalia, Rehnquist, O'Connor, and Kennedy, rejected it.

      I doubt if Roberts would accept it.  But, even with Roberts on board, with Alito and Thomas that makes three votes.
