    by filibustering.

    We HAVE the votes (if the Senate Dems play hardball with the unwilling).

    If the GOPers go nuclear, the Dems lose NOTHING (if it sticks, the filibuster simply didn't exist as an option at all).

    But going nuclear would make it clear to all just how radical the GOP now is, and I'm sure that it would cost them in November.

    Anything that gets rid of the notion that the Dems have some kind of duty not to "obstruct" Bush (ugh, what a thought - obstruct? You STEP on cockroaches) is a good thing.

    I personally think that the Dems should hold "nuclear" GOPers hostage via parliamentary maneuvers, but even withoput that, the Dems should go for the filibuster itself.

    They really have nothing whatsoever to lose.

      You are dead on.  Alito is a big deal and has nothing to do with abortion, womens rights, or the Princeton Alumni Klan.  All the garbage that Bush has been doing, consolidating power, letting his friends rob us blind, anything you and I would consider gross misconduct and impeachable offenses can be swept under the rug.  I see Alito as Karl Roves ability to rewrite the constitution.  He's von Hindenburg for those unafraid of Godwin's law.  He is the power that would trump our truth.  Speaking truth to power?  Meet the right wing supreme court.

          And then, when the Dems win back the House, Senate and the presidency, you simply change the rules and KICK OUT Roberts, Thomas, Scalia and Alito. Simple. Based on their unfitness to sit on the highest court in the land, or whatever. If Rethugs can change ANY RULE, FOR ANY REASON, to suit their agenda, then that would simply be a common-sense thing to do, for the health and future of the Constitution and the country at the very least.

      Thank you phrasing that so well.  The Dems in the House and Senate have been answering our rising anger and frustration for ages by telegraphing that they're holding their fire for a battle they can win, being a gracious minority party until they can go in for the kill.

      What have they been keeping their powder dry for if not for this?  Enough with measured words and careful tactical moves!  They have to stand for something, even if they lose, because no one respects someone who holds to no absolutes.  I hope Gov. Dean is pushing them hard to STAND UP.

      Stupidity should be painful.
