    I e-mailed this to her before she came out "No" on cloture. Tried to fax this to Akaka this morning since I'm a former kamaaina (he'll know that reference)but got a error message as undeliverable so will try again later.

    Dear Senator Feinstein,

    The issue of Judge Samuel Alito and his appointment to the U.S. Supreme Court is NOT a partisan issue.  Forget about Judge Alito's stand on a woman's right to choose, forget about the fact that he has ruled for the corporation against consumers and workers in the majority of such cases brought before him, forget that he might be even to the right of Justices Scalia and Thomas.  What you must remember is that Judge Alito believes in the Unitary Executive rule, that he believes the Executive Branch can determine the constitutionality of law, that the President, as the occupant of the Executive Branch, can decide Congress's intent.

    This is WRONG. Our U.S. Constitution was specifically written to preclude rule by King or Emperor.  It set forth Three Branches of Government that would govern TOGETHER.  Judge Alito does NOT believe in the U.S. Constitution. He believes in a powerful, sole ruler of the Executive Branch.

    If you confirm him, you will have made Congress a moot point, a footnote in our history. You will have made the last recourse to address the people's concerns, the Judiciary, essentially a sham.

    Please do not confirm this man. Please do everything in your power to stop the confirmation of this man. Please vote NO or abstain on cloture.
