    you don't sacrifice one avenue of attack over the other. again, illegality is the #1 issue here.  ineffectiveness in capturing terrorists is secondary, but must also be stressed.

    •  Kennedy chose his line of attack (none)
      His narrative is that Bush is using this program to go after terrorists.  You might stress that both lines of attack are necessary, but Kennedy wouldn't agree with you.  

      Again, his narrative is wrong because it imputes good motives to Bush and assumes he is trustworthy.  This is bad politics and it's wrong.  We all know Bush is a tyrant.  If we frame this as Bush is going too hard on terrorists we let him escape from his record of clear tyrannical behavior.
