    The administration can't really now ask congress to change FISA, because to date they have been unable to articulate a single plausible reason why FISA was unworkable for them.

    Also, it would be a tacit agreement that the program is illegal.  The Admin is hoping to bluff through that the program is legal, and will argue that to the extent it violates FISA, FISA is unconstitutional.

    In a way, Kennedy is finding a new way to force them to put to words what it is they find unworkable about FISA.  If it comes out that it is about mass data mining of the emails and phone calls of all Americans, the tinfoil hat crowd will be vindicated and the Administration will look very bad.

    I think the average citizen is ok with administration officials occasionally mistaking a normal person for a terrorist, but not to find the government is actually monitoring EVERYTHING from EVERYONE.  That won't fly, and most people have not caught on that the current state of technology allows for that type of thing.
